This page summarizes the most common questions from Hosts on SpotMe Now (Anexo A). Answers are aligned with the Host Operating Guide (08-V-26) and current Anexo A. For complete rules see the 

Is SpotMe a landlord, sublessor, or party to the contract with the Depositante?

No. SpotMe is not a party to any contract between the Host and the Depositante. SpotMe provides the technology platform and acts as a collection agent to facilitate payments.

Does SpotMe guarantee the use of the Space or the Depositante’s behavior?

No. SpotMe does not guarantee occupancy, the Depositante’s conduct, or compliance with obligations derived from private contracts between Users.

Does SpotMe intervene in the private contract negotiation?

No. Commercial, legal, and operational conditions for using the Space are defined exclusively by the Host and accepted by the Depositante.

Payment made by the Depositante through the platform is considered made directly to the Host. Stripe processes the payment as a technology provider, and SpotMe acts as a collection agent.

Why is the payment considered made to the Host if Stripe processes the charge?

Because Stripe acts as an independent provider of payment processing technology services and SpotMe as a collection agent. The economic beneficiary of the Contraprestación is the Host.

Does SpotMe receive or hold the Depositante’s money?

No. SpotMe does not receive or hold the funds as owner. It only facilitates processing and, when applicable, reversals or refunds through the payment provider. SpotMe does not assume a direct payment obligation to the Depositante.

You receive Recursos, calculated as: Contraprestación − Tarifa de Servicios − Tarifa de Procesamiento − IVA/ISR withholdings (when applicable). Details per concept in 

Can I receive payments outside the platform?

No. The Host must not receive cash, direct transfers, or payments through channels other than the Site. Doing so violates the Terms and Conditions.

The Host is responsible for issuing the CFDI to the Depositante for 100% of the Contraprestación.

Why invoice 100% if I receive a smaller net amount?

Because the Tarifa de Servicios and Tarifa de Procesamiento are Host expenses for using the platform and processing payment, invoiced to you separately by SpotMe. Withholdings applied by SpotMe do not modify the total amount that must be invoiced to the Depositante.

Should I add IVA on the total charged to the Depositante?

Yes. IVA is calculated on the Contraprestación per the published price, regardless of later deductions for Tarifa de Servicios, Tarifa de Procesamiento, or tax withholdings.

Are the Tarifa de Servicios and Tarifa de Procesamiento deductible?

Generally yes, when they are indispensable for your activity, you have the corresponding CFDI SpotMe issues to you, and you meet other tax requirements. Confirm with your accountant.

Yes. All SpotMe Now operations are invoiced one month in advance per the Operating Guide. Recurring CFDI within the first 10 days of each month; new-operation CFDI within 5 days of payment or before month-end.

How do I know which operations to invoice?

SpotMe provides a monthly report of active operations and processed payments within the first 3 calendar days of each month, plus a new-bookings report within 3 days of each occurrence.

What if the Depositante requests a CFDI after payment?

If the Depositante provides their fiscal data on time through the Site, you issue the CFDI per the operational report.

What if the Depositante does not request a CFDI or provide fiscal data?

You may issue a global CFDI (público en general) following the tax practice validated with your accountant.

How are already-invoiced cancellations handled?

You issue a credit note (CFDI de egreso) and refund the corresponding proportional amounts, including the proportional Tarifa de Servicios when applicable. The Tarifa de Procesamiento is not refundable. You must upload the credit note and the bank receipt of the refund to the Site.

Does SpotMe refund payments to the Depositante?

No. SpotMe does not refund on the Host’s behalf. Refunds are issued exclusively by the Host. SpotMe calculates the amounts, reimburses the Host the proportional Tarifa de Servicios, and the Host transfers to the Depositante. If the Host fails to refund, SpotMe can apply compensation against pending funds.

Is the deposit part of the Contraprestación?

No. The deposit is not Contraprestación for use of the Space.

Is the deposit invoiced or does it incur IVA?

Not while it retains its nature as a deposit. Only if it is applied and becomes income should its tax treatment be analyzed.

Does SpotMe charge a Tarifa de Servicios on the deposit?

Not on the deposit itself. Stripe’s Tarifa de Procesamiento does apply — it is added on top of the deposit and paid by the Depositante.

The Host is solely responsible. SpotMe does not return deposits or hold funds for that purpose. Any balance owed to the Depositante must be returned within 30 calendar days of move-out. More detail in 

What happens if I don’t respond to a request?

If you neither accept nor reject the request within 48 hours, it is automatically rejected.
